1. Contract of Sale:

When you place an order to purchase a product from Vape Gallery Ltd we will send you an e-mail confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a product which is accepted by us when we send e-mail confirmation to you that we’ve dispatched that product to you (the “Dispatch Confirmed E-mail”). That acceptance will be complete at the time we send the Dispatch Confirmed E-mail to you. Any products on the same order which we have not confirmed in a Dispatch

Confirmed E-mail to have been dispatched do not form part of that contract.

2. Warranty and Returns:

We offer a 90-day guarantee on all products sold on this site. The 90 day period starts from the date you receive your order. Faulty items may be returned to us for replacement within this time. Delivery costs for returns under guarantee will be borne by Vape Gallery LTD. In addition to your 90-day returns guarantee, customers are entitled to return goods within 7 working days of receipt under the European Union Distance Selling Act.

3. Pricing and availability:

We list availability information for products sold by us on the website on each product information page. As we process your order, we will inform you by e-mail if any products should be unavailable. We reserve the right to change any and all prices on our website without notice.

4. Persons under the age of 18:

Our products may not be purchased or used by any person under the age of 18 years. By purchasing from us you declare that you are aged over 18 years on the date on purchase.

5. Electronic communications:

When you visit Vape Gallery website or send e-mails to us, you are communicating with us electronically. We communicate with you by e-mail or by posting notices on the website. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

6. Alteration of Service or Amendments to the Conditions:

We reserve the right to make changes to our website, policies, and these Terms and Conditions at any time. If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

7. Events beyond our reasonable control:

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.

8. Your Account:

If you use the website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner. Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when registering. You can access and update much of the information you provided us within our Account area of the website. Vape Gallery Ltd reserves the right to refuse access to the website, terminate accounts, remove or edit content, or cancel orders at our discretion. If we cancel an order, it will be without charge to you.

10. Access to Vape Gallery Web Sites:

We will do our utmost to ensure that availability of the website will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. Also, your access to the website may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

15. Governing law and jurisdiction:

These conditions are governed by and construed in accordance with the laws of the Republic of Ireland, and the European Union Distance Selling Act.

16 Shipping Terms

While every effort is made to ensure the availability of products and to fulfill all orders, Vape gallery cannot guarantee the availability of any product displayed on the website. Vape Gallery reserves the right to discontinue the sale of any good or service listed on this Site at any time without notice. Promotional offers at Vape Gallery retail outlets may not always be available on the Site and promotional offers listed on the Site may not always be available at Vape Gallery retail outlets. Vape gallery cannot confirm the price or availability of a product until your order is received.

Our goal is to maintain a completely accurate Site. In the event that price or other errors are discovered, we will promptly correct them and the amended provision will apply. Vape Gallery reserves the right to change or amend prices or promotional offers at any time without notice.

Orders received and paid for before 1 pm Monday to Friday (excluding bank holidays) will be dispatched that day by DPD couriers. We ship to Ireland only.

Orders received after 1 pm or over the weekend will be dispatched on the next working day. Orders usually arrive the next day from the day they are shipped (for Ireland) but there may be occasional times when it takes 1 to 3 days.

Shipping cost is €5 for orders up to €99.99 and is free for orders €100 and above.

Within Ireland, we ship by Fastway Couriers and a signature will be required upon delivery. All deliveries will need to be signed for. Please ensure somebody will be available at your chosen delivery address to sign for your order. If a package is returned to us, the customer will be charged for the costs of re-delivering.

Deliveries by Fastway couriers can be tracked online. You will be emailed a tracking number for your delivery once your order has been dispatched.

You can for your order by Sagepay or pay by phone and pay in store for collect in store option.

Orders will not be dispatched until full payment has been received.

We also offer a collection service where orders can be collected at our retail shop in Ennis County Clare. Please note any orders ordered through collection service that are not payed for in advance can only be held until the end of the next working day. Orders paid for in advance for collection will be held for you until you can collect.

17 Returns Policy

We are confident that you will be happy with your purchase. However, should you feel it necessary to return an item, we aim to make the returns process as simple as possible. You will be required to return the goods, unopened and as new with a copy of your original invoice. On receipt, we will issue an exchange or refund.
Please see individual product for individual warranty, as most e-cigarette products are considered to be disposable. Additionally, some products only have a “Dead On Arrival (DOA)” warranty.
Unfortunately, in these circumstances, you will be responsible for any costs incurred in returning the goods. Please contact us. Your statutory rights are not affected.

Returns – Faulty Goods or Damage in Transit
In the unfortunate case of products being faulty or damaged in transit, we will offer you the choice of either a replacement or a full refund and Vape Gallery will cover postage costs where goods have to be sent back in this instance.

Cooling Off Period / Cancellation
You may return a product within 7 days for no reason, as long as the product it is unused, unopened and in the same condition as received. Return costs will have to be paid for by the buyer in this instance.

For health & safety reasons we do NOT accept returns of eLiquids.
